Terms of Service
1. Operator and acceptance
This website is operated by The Craftsmen’s House Ltd, trading as The Craftsmen’s Boutik (‘Company’, ‘we’, ‘our’), registered office: St Denis Street, 2 River Court, Port Louis, 1112-07 MU. These Terms govern access to https://thecraftsmensboutik.mu. By using the site, you agree to these Terms to the extent enforceable under applicable law.
2. Purpose and intended audience
The site is a corporate, brand and product information platform intended principally for business customers, including hotels, restaurants, cafes, foodservice operators, independent retailers and prospective supermarket partners. It is not a retail checkout platform, and the Company does not currently offer online payment or automatic order acceptance through it.
3. Product descriptions and brand materials
We aim to present reliable product information, but images, packaging, formulations, specifications and availability may change. Images are illustrative. Before confirming a purchase, customers should request current product details relevant to their use, including ingredients, allergens, labelling, shelf life, storage and pack sizes. We do not exclude liability for any representation or duty that cannot lawfully be excluded.
4. Enquiries, requests to order and quotations
A form submission, product enquiry or request to order is an invitation for our sales team to contact the requesting business; it is not a confirmed order, an acceptance of an offer or a binding contract for supply. We may respond by email or telephone to discuss availability, quantities, price, taxes, delivery and payment terms. An automatic acknowledgement only confirms receipt. A sale arises only through a later agreed commercial process, such as an expressly accepted quotation or written order confirmation, subject to the agreed terms and applicable law.
5. No published prices; individually negotiated terms
Product prices are not displayed on this website. Pricing is provided individually following a business enquiry or request for quotation and may vary by customer, order quantity, product mix, commercial arrangement and delivery requirements. A quotation is subject to its stated validity, tax treatment, availability and conditions. We may revise an unaccepted quotation; nothing here overrides a binding agreement already concluded.
6. Business authority and accurate enquiries
Anyone making a request on behalf of a business should have authority to communicate for that business and should provide accurate contact and request details. We may seek additional information before establishing an account or proceeding with a quotation. Submission of an enquiry does not guarantee supply or trade-credit approval.
7. Separate B2B sale agreements
These Terms apply to website use and enquiries, not to the full terms of a later wholesale sale. Payment, credit, title and risk, delivery, inspection, returns, warranties, promotions and other commercial matters will be governed by the quotation, order confirmation or separate B2B terms agreed with the customer. Supermarket and key-account agreements may contain additional negotiated provisions.
8. Intellectual property and trademarks
Original website text, design and materials belonging to the Company are protected by applicable law. Third-party trademarks, brand names, product photography and related intellectual property remain owned by their respective rights holders. Display of a brand does not transfer ownership or imply that the Company owns that brand. Website material may be viewed for legitimate information and business-enquiry purposes but must not be reproduced or commercially exploited without required permission.
9. Acceptable use
You must not use the website unlawfully, submit fraudulent or knowingly misleading requests, attempt unauthorised access, introduce malicious code, disrupt site operations or infringe intellectual property rights. We may restrict access where reasonably necessary for security or to prevent misuse.
10. Third-party links
Links to brand owners, manufacturers and other independent sites are provided for convenience. Their content, availability and privacy practices are controlled by those third parties. A link is not necessarily an endorsement.
11. Availability and changes
We may update, suspend or maintain the website and cannot guarantee uninterrupted or error-free access. We may revise these Terms from time to time; the current version and its effective date will be posted on this site. Changes do not retrospectively alter an existing binding commercial contract.
12. Liability and mandatory rights
To the maximum extent permitted by Mauritian law, we exclude liability for indirect or consequential losses arising solely from website access or inability to access it. We do not exclude or restrict liability for fraud, deliberate wrongdoing, misleading statements or other liability that cannot lawfully be excluded. Nothing in these Terms limits mandatory statutory rights.
13. Privacy
Personal information submitted through this website is handled as described in our Privacy Policy, available on this website. A business enquiry does not by itself constitute consent to unrelated promotional communications.
14. Governing law and contact
These website Terms are governed by the laws of the Republic of Mauritius. Subject to mandatory applicable law, disputes relating to these Terms fall within the jurisdiction of the competent courts of Mauritius.
